Govt moves to curb cheap penicillin drug imports for the next one year

The government has amended the import policy for select penicillin-based products, imposing restrictions on low-priced imports of Penicillin G-potassium, Amoxicillin Trihydrate and 6-APA for a period of one year.

On January 29, 2026, the Directorate General of Foreign Trade said imports of Penicillin G-potassium (PEN-G) under ITC (HS) code 29411010 with a CIF value of less than ₹2,216 per kg will be classified as “Restricted”. Imports above this threshold will continue to remain under the “Free” category, subject to registration and other requirements administered by the Drug Controller General of India under the Drugs and Cosmetics Act.

Similarly, imports of Amoxicillin Trihydrate and its salts under ITC (HS) code 29411030 will be restricted if the CIF value is below ₹2,733 per kg. Imports of 6-APA under ITC (HS) code 29411050 will face restrictions if the CIF value is less than ₹3,405 per kg.

The notification clarified that the minimum import price conditions will not apply to imports made by 100% Export Oriented Units, units operating in Special Economic Zones, or imports under the Advance Authorisation Scheme, provided that the imported inputs are not sold in the Domestic Tariff Area.

According to the government, the revised policy conditions take effect immediately and will remain in force for one year from the date of publication of the notification. During this period, imports of the specified products below the notified CIF values will require specific authorisation.

The changes have been made by exercising powers under the Foreign Trade (Development & Regulation) Act, 1992, read with relevant provisions of the Foreign Trade Policy 2023, as amended from time to time.

The notification was issued with the approval of the Minister of Commerce and Industry and signed by the Director General of Foreign Trade.
